Purpose and Reason:
Effective April 13, 2010, resource limits for the Qualified Medicare Beneficiaries (QMB), Specified Low-Income Medicare Beneficiaries (SLMB) and Qualifying Individuals (QI) Programs are $6600 for a single person and $9910 for a married person living with a spouse and no other dependents. This emergency amendment raises the resource limits to be consistent with provisions of the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA), PL 110-275, as well as removes barriers to applications for the Medicare Part D Low-Income Subsidy (LIS) and the Medicare Savings Programs (MSP). Applications received from January 1, 2010 to the adoption of this rule will be reviewed using the higher resource limits.
Brief statement of Reason for Finding Imminent Peril:
The Department of Human Services believes the emergency amendment of this rule is necessary to ensure the resource limit for QMB, SLMB and QIs conform to the resource limits for individuals who qualify for the full subsidy Medicare Part D LIS.
