Purpose and Reason:

EOHHS amended this rule in order to reflect the fact that there is no cost-of-living increase (COLA) to the federal Social Security Administration benefit rates in 2016. The Centers for Medicare & Medicaid Services (CMS) published this information in its Informational Bulletin on November 20, 2015. These rules were originally filed as “emergency” rules and took effect on January 1, 2016. The State is adopting these amended rules to set forth these provisions in a timely manner in order to prevent wrongful denial, discontinuance, or interruption of benefits for Medicaid applicants and beneficiaries.
