Purpose and Reason:
The Executive Office of Health & Human Services (EOHHS) is filing an “emergency” rule to incorporate recent changes to the Federal Poverty Levels (FPLs) into existing applicable rules. Medicaid Code of Administrative Rules Section #0362 is affected by these changes. Effective March 1, 2016, this Medicaid rule (#0362) will be amended to reflect the 2016 changes in the FPL guidelines that were cited in the February 10, 2016 State Agency Regional Bulletin from the Centers for Medicare and Medicaid Services.
