Regulation Authority:

RIGL 40-8; Title XIX of the Social Security Act

Purpose and Reason:

Effective March 1, 2008, to update the Medical Assistance poverty level income standards and maintenance needs allowance in accordance with the 2008 Federal Poverty Guidelines; and average costs of care used to calculate penalty periods for prohibited resource transfers and waiver cost effectiveness.

Brief statement of Reason for Finding Imminent Peril:

To prevent beneficiaries from being deprived of benefits that are needed for their support.
