Regulation Authority:

RIGL 40-8; Title XIX of the Social Security Act

Purpose and Reason:

Effective March 1, 2007 to update the Medical Assistance Poverty Level income standards and maintenance needs allowance in accordance with the 2007 Federal Poverty Level Guidelines; and average costs of care used to calculate penalty periods for prohibited asset transfers and waiver cost effectiveness.

Brief statement of Reason for Finding Imminent Peril:

To avoid the wrongful denial/discontinuance of benefits to applicants/beneficiaries
