Purpose and Reason:
This amended rule reflects revised language derived directly from the Code of Federal Regulations, specifically Part 416: Supplemental Security Income for the Aged, Blind and Disabled, to assure that disability reviews are conducted with uniformity and objectivity. Amendments further reflect a five-step evaluation process that is followed when determining whether or not an adult individual qualifies for Medical Assistance on the basis of a disability; standard criteria for treating medical and other evidence submitted to support a reported impairment; and guidance regarding drug addiction and alcohol, prescribed treatment and conduct of the hearing if an individual is denied Medical Assistance.
