Purpose and Reason:
Pending approval from the Centers for Medicaid and Medicare Services (CMS), effective October 1, 2009, state-funded Medical Assistance shall be provided to non-citizen children under the age of 19 who are otherwise eligible aliens lawfully residing in the United States. Such aliens consist of qualified aliens subject to the 5-year bar, aliens described in 8 CFR 103.12(a)(4), and legal non-immigrants whose admission to the U.S. is not conditioned on having a permanent residence in a foreign country (such non-immigrants include citizens of the Compact of Free Association States who are considered permanent non-immigrants but does not include visitors for business or pleasure or students).
