Purpose and Reason:
Updated Section 0702.05, RIW CHILD SUPPORT CASES, 0704.20 MONEY COVERED BY THE ASSIGNMENT and 0704.20.05 Unassigned Money to reflect RI Works vs. FIP as well added language to provide for pre-existing past due support paid by a noncustodial parent for a child receiving RIW benefits, for the period of time that the family was not in receipt of RIW benefits, to be paid to the family in which the child resides. These households may retain the past due amount as an amount owed to them personally.
Brief statement of Reason for Finding Imminent Peril:
Effective 10/1/09 rule reflects provisions for pre-existing past due support paid by a noncustodial parent for a child receiving RIW benefits, for the period of time that the family was not in receipt of RIW benefits, to be paid to the family in which the child resides. These households may retain the past due amount as an amount owed to them personally.
