Purpose and Reason:

Supplemental Security Income is a federal program that provides monthly benefits to people who are age 65 or older, blind or disabled and who have low income and limited resources. The State of Rhode Island supplements the federal benefit rate. The Department of Human Services (DHS) began administering the state supplemental portion of monthly Supplemental Security Income (SSI) benefits January 1, 2011. RI General Law was amended July 1, 2012 to provide a State payment for the benefit of disabled and elderly individuals residing in assisted living facilities not eligible to receive Title XIX funding of the Social Security Act. This proposed revised rule includes provisions filed under emergency rule-making effective September 24, 2012 for the DHS to administer the payment to assisted living facilities. This monthly payment is equal to two-hundred and six dollars ($206) per individual per month subject to available funding. The Department of Human Services is authorized to implement these payments subject to funding made available through the Rhode Island General Assembly. The rules further include the authority to make retroactive payments back to July 1, 2012 to facilities that provide the necessary documentation regarding eligible residents. The Department will reach out and work directly with the facilities regarding verification and documentation requirements for payments. Additional proposed revisions update the rules to reflect the current business process to ensure accurate payments in instances when the benefit amount changes at redetermination.
