Subchapter 00 N/A
Part 5 Supplemental Security Income and State Supplemental Payment Rules and Regulations (218-RICR-20-00-5)
Type of Filing Amendment
Regulation Status Inactive
Effective 12/23/2021 to 03/02/2022

Regulation Authority:

R.I. Gen. Laws § 40-8
Title XVI of the Social Security Act
R.I. Gen. Laws § 42-12.4-1 et seq.
R.I. Gen. Laws § 40-6-27.2

Purpose and Reason:

Removal of references to Category F and its associated amounts for reinvestment into enhanced Assisted Living Residences per State statute.

Removal of reference of state subsidy funding to the assisted living providers that was financed by RIHMFC per State statute.

Adding the 2022 cost of living adjustment as determined by the Social Security Administration.

Brief statement of Reason for Finding Imminent Peril:

The Rhode Island State Fiscal Year 2022 budget (21-H-6122) mandates the elimination of the Category F program established in 2016 and reinvestment of the state savings into enhanced Medicaid Assisted Living rates. This will be implemented on November 1, 2021.

The COLA increase of 5.9% is being implemented by SSA in response to the effects of inflation on household goods and healthcare.
