Purpose and Reason:
Updated Section 1424.40.10, Support Paid through family Court, to reflect pre-existing past due support paid by a noncustodial parent for a child receiving RIW benefits, for the period of time that the family was not in receipt of RIW benefits, to be paid to the family in which the child resides. These households may retain the past due amount as an amount owed to them personally. Any such payment to the household will be treated as Lump Sum Income, if it is in excess of the allowed monthly pass through amount.
Brief statement of Reason for Finding Imminent Peril:
Effective 10/1/09 RIWORKS recipients will no longer have to assign their preexisting past due child support to the State as a condition of eligibility for RIWORKS benefits. They may retain this past due amount as an amount owed to them personally. This does not affect past due amounts that accrue while they are receiving RIWORKS benefits. That amount will accrue while they are receiving RIWorks benefits. All federal distribution rules continue to apply.
