RIGL 23-17.8

Purpose and Reason:

RIGL §23-17.8-2 has established a requirement for licensed health care providers and professionals to report allegations of abuse, mistreatment, or neglect to HEALTH and the Long-term Care Ombudsman. However the current regulations do not refer to the requirement or reference the statute. These amendments would establish that requirement in regulation

Brief statement of Reason for Finding Imminent Peril:

Recent inspections and investigations of Home Nursing Care and Home Care Provider [HNCP/HCP] licenses indicate providers are not adequately aware of the RIGL §23-17.8-2 reporting requirement and instances of neglect and allegations of potential abuse, mistreatment, or neglect are not being reported to HEALTH and the Long-term Care Ombudsman.
