Purpose and Reason:
This new rule provides procedures to implement the provisions of federal and state law relating to legal guardianship and guardianship assistance. The Fostering Connections to Success and Increasing Adoptions Act of 2008, Public Law 110-351, authorizes the federal Guardianship Assistance Program (GAP), which allows states to provide kinship guardianship assistance payments to kin who assume legal guardianship of children for whom they have cared while foster parents. Rhode Island General Law 40-11-12 allows the Family Court to appoint a guardian for a child if the child has been placed in the care, custody and control of DCYF and RIGL 40-11-12.3 allows for the provision of guardianship assistance. The final rule does not include any changes from the proposed rule other than editing changes.
