Purpose and Reason:

By this rulemaking, BHDDH is proposing to amend existing regulations to adopt prevailing standards for the licensure and operation of facilities and programs providing behavioral health services for adults who are not in the custody of the Department of Children, Youth, and Families (DCYF), and/or substance use disorder services for children and adults.  Reiterates definitions of Advanced Practice Registered Nurse; Licensed Practical Nurse; Mental Health Professional; Qualified Mental Health Professional; and Registered Nurse; establishes new rule to inform BHDDH of Economic Distress and Going Concern Issues; establishes new rule to inform BHDDH of staff shortages; clarifies qualifications of certain supervisors; adds LPNs to team staff and delineates supervision required; adds APRNs to those who can conduct biopsychosocial assessments; clarifies that practice standards are set for SUD treatment providers; adds APRN as potential provider of co-occurring clinical services and as potential on-site supervisor; allows supervised LPN to substitute for second required RN in IHH and ACT staffing; allows APRN to substitute for required psychiatrist in ACT staffing; adds APRN as potential 24/7 on-call psychiatric services for residential BHO programs; allows supervised LPN to substitute for RN for purpose of Behavioral Health Stabilization Unit admissions; allows supervised LPN to substitute for required RN for specific roles during Behavioral Health Stabilization Unit admissions and for on-site coverage of BHSU; adds CARNs/CARN-APs as potential supervisors of Medical Detoxification Units; adds supervised LPNs as substitutes for on-site RNs; adds supervised LPNs as substitutes for on-site RNs in Outpatient Detoxification programs; technical changes to drug administration security rule and to Health Home Service Provision requirement for MOUs to now include alternative agreements.
