Purpose and Reason:
The purpose of these amendments is to incorporate anticipated statutory changes to be made in the 2014 session of the Rhode Island General Assembly. (See Article 27 of the 2014 budget bill (House Bill 7133)). The amendments relate to the treatment of life estates with enhanced powers (so-called “Ladybird deeds”) in determining Medicaid eligibility. Under the new provisions, a Medicaid applicant/beneficiary who is in possession of a life estate with enhanced powers created after July 1, 2014 will have to revoke the powers and take ownership in the life estate in order to be eligible for Medicaid benefits.
