Purpose and Reason :

The purpose of this regulation is to administer and enforce the provisions of the R.I. Contractors Law, R.I. Gen Laws Chapter 5-65. This regulation applies to any person or entity that offers to undertake or submit a bid to do work as a contractor on a structure or arrange to have work done. These persons and entities include, but are not limited to carpenters, including finish carpenters and framers; siding installers; roofers; foundation installers, including concrete installers and form installers; drywall installers; plasterers; insulation installers; ceramic tile installers; floor covering installers; swimming pool installers, both above ground and in ground; masons, including chimney installers, fireplace installers, and general masonry erectors. The regulation does not apply to employees of a registered contractor. Further, this regulation sets forth the requirements for registration and promotes public safety, health, and welfare by providing a mechanism to ensure that all contractors conducting business in the State of Rhode Island have the requisite skills, training, and experience necessary to safety and adequately conduct contractor activities within this state. Any person who fails to license as a contractor, as stipulated, is subject to penalties for operating without a license. 

The proposed regulation amends and expands on the current regulation and supplements the statutory requirements by:

o   General administrative requirements

o   Registration requirements

o   Application process

o   Educational Requirements;

·         Describing in greater detail the CRLB Complaint process, including

o   Notice of accepted complaints and initial CRLB investigation

o   Prehearing conferences and alternative dispute resolution

o   Violations

o   Appeals

o   Criminal Prosecution;

·         Describing the process by which the CRLB shall conduct administrative hearings, including;

o   Expungements

o   Default

o   Disqualification/Incapacity of Hearing Officer

o   Miscellaneous provisions

o   Hearings – Public Information

o   Publication of Orders and Notices; and

·         Establishing the Standards of Professional Practice.
